1. Definitions
- "Agreement" — these Terms & Conditions, together with our Privacy Policy and Cookie Policy
- "Cognita", "we", "us", "our" — Cognita, operated from 63/2 Nimmanhaemin Soi 9, Su Thep, Mueang Chiang Mai, Chiang Mai 50200, Thailand
- "User", "you", "your" — any person who accesses our website or enrols in a course
- "Service" — the online AI development courses and related support provided by Cognita
- "Content" — all materials, lessons, exercises, worked solutions, and feedback provided as part of a course
- "Platform" — the website at cognitak.world and any associated learning environment
2. Acceptance of Terms
By accessing our website or enrolling in a course, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you should not use our website or enrol in our courses.
You must be at least 18 years of age and legally capable of entering into a binding agreement. By proceeding, you represent that these conditions apply to you.
3. Service Description
Cognita provides structured online courses in AI development, including Programming for AI Basics, Model Building Workshop, and Long-Form Mentorship Course. Courses are delivered online and are open to learners worldwide, subject to payment of the relevant course fee.
We reserve the right to modify, postpone, or cancel a course offering with reasonable prior notice. Where a cohort is cancelled before it begins, enrolment fees will be refunded in full.
4. Accounts and Enrolment
Enrolment in a course creates a learner account for you on our platform. You are responsible for keeping your access credentials secure and for all activity that occurs under your account.
Your enrolment is personal to you and may not be transferred to another person without our written consent.
5. User Responsibilities
When using our platform and attending sessions, you agree to:
- Engage with course materials in good faith and complete your own work
- Treat instructors and other learners with respect
- Not share course materials, passwords, or access with third parties
- Not reproduce or redistribute Cognita's course content without written permission
- Not use the platform for unlawful purposes or in a way that could harm others
We reserve the right to remove a learner from a course without refund if these responsibilities are not met.
6. Intellectual Property
All course materials, lessons, exercises, worked solutions, and written feedback remain the intellectual property of Cognita. Enrolling in a course grants you a personal, non-exclusive, non-transferable licence to access and use those materials for your own learning during the course period.
You retain ownership of code and projects you write yourself as part of the course.
7. Payment Terms
Course fees are stated in Thai Baht (฿) and are due in full before access to course materials is provided. Payment details are provided on enquiry.
Refund Policy
- Cancellation at least 7 days before the cohort start date: full refund
- Cancellation within 7 days of the cohort start date: 50% refund
- Cancellation after the cohort start date: no refund, except where Cognita cancels the cohort
- If Cognita cancels a cohort before it begins, a full refund will be issued within 14 business days
8. Course-Specific Terms
- A completion record is issued when you submit the required project and it is assessed by an instructor. It is not issued automatically upon enrolment.
- Completion records are internal Cognita documents and do not constitute a nationally or internationally recognised qualification.
- We make no representation about the impact of completing a course on your employment prospects or technical standing.
- Live sessions (where applicable) are scheduled in Indochina Time (ICT, UTC+7). We will give at least 48 hours' notice if a session must be rescheduled.
- Academic integrity is required. Submitting work that is not your own as your project submission is a breach of this Agreement.
9. Disclaimers
Our courses are provided in good faith and with care, but are provided "as is" without warranties of any kind, express or implied. We do not warrant that:
- The platform will be uninterrupted or error-free at all times
- Completing a course will result in any specific employment outcome, salary change, or skill level
- The content will remain current indefinitely (though we do review it quarterly)
10. Limitation of Liability
To the extent permitted by Thai law, Cognita's liability to you for any claim arising from this Agreement is limited to the course fee you paid. We are not liable for any indirect, consequential, or incidental loss including loss of earnings, loss of data, or loss of opportunity.
Nothing in this Agreement limits our liability for fraud, death, or personal injury caused by our negligence.
Force majeure: we are not liable for delays or failures caused by circumstances beyond our reasonable control including natural disasters, civil unrest, or infrastructure failures.
11. Indemnification
You agree to indemnify Cognita and its instructors against any claims, losses, or expenses (including reasonable legal fees) arising from your breach of this Agreement, your misuse of the platform, or your violation of any third party's rights.
12. Termination
Either party may terminate this Agreement. You may withdraw from a course at any time, subject to the refund terms in Section 7. We may terminate your access if you breach Section 5 (User Responsibilities) without refund.
On termination, Sections 6, 9, 10, 11, and 13 survive and remain in effect.
13. Dispute Resolution
This Agreement is governed by the laws of the Kingdom of Thailand. In the event of a dispute, we encourage you to contact us first at [email protected] to resolve the matter informally. If an informal resolution is not reached within 30 days, disputes may be submitted to the competent courts in Chiang Mai, Thailand.
14. General Provisions
- Entire agreement: This Agreement constitutes the entire agreement between you and Cognita regarding use of our courses and website.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision is not a waiver of the right to do so later.
- Assignment: You may not assign your rights under this Agreement without our written consent. We may assign our rights to a successor entity.
- Notices: Formal notices to Cognita should be sent to [email protected].
15. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. For significant changes affecting active learners, we will provide notice by email at least 14 days before the changes take effect. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
